Terms of Use

Article 1 — Purpose

These Terms of Use (ToU) govern access to and use of the HebdoCook service, accessible at hebdocook.com, offered by [Company name]. By creating an account, the user fully and unconditionally accepts these ToU and the Privacy Policy.

Article 2 — Available offers

HebdoCook offers two levels of access:

The Pro offer price can be consulted on the application's subscription page. The terms of sale are detailed in the GTS.

Article 3 — Registration and user account

Use of HebdoCook requires the creation of an account with a valid email address. The service is reserved for adults or minors with authorisation from their legal representative. The user is responsible for the confidentiality of their credentials and any activity carried out from their account.

The user may delete their account at any time from settings (Account section). A grace period of 30 days applies: during this period, the account is deactivated but deletion can be cancelled. After this period, deletion becomes permanent and irreversible.

Article 4 — User content and visibility

The user retains ownership of the recipes and content they create. They choose a visibility level for each:

By publishing a recipe in Public mode, the user grants HebdoCook a non-exclusive, free and worldwide licence to display and distribute it to other users of the platform.

The user may change the visibility or delete their recipes at any time from their personal space. In the event of account deletion, recipes published in Public mode are retained in anonymised form (the author's name is replaced by their username or by "HebdoCook"). If the user wishes their recipes to be permanently deleted, they must delete them manually before closing their account.

Article 5 — Features reserved for the Pro offer

Certain features are exclusively accessible to Pro subscribers:

Article 6 — Usage rules

The user undertakes to use HebdoCook in a lawful and respectful manner. The following are notably prohibited: publishing offensive, misleading or rights-infringing content; intellectual property rights violations; any attempt at unauthorised access to the service or its data.

Uploaded images are limited to 5 MB per file (accepted formats: JPG, PNG, WebP), with a maximum of 75 uploads per day and 15 per hour per account.

Any breach of these rules may result in the temporary suspension or permanent termination of the account, including a permanent ban, without notice or refund (see Article 8).

Article 7 — Account deletion and data fate

Upon permanent deletion of an account, data is processed as follows:

A reminder email is sent 7 days before permanent deletion, then 2 days before.

Article 8 — Suspension, termination and ban

HebdoCook reserves the right to temporarily suspend or permanently terminate any account in the event of a breach of these ToU, abusive use of the service, or behaviour harmful to the community or the platform.

In the most serious cases (fraud, harassment, damage to the integrity of the service), HebdoCook may impose a permanent ban on the account and associated email address. These measures are taken without notice and without any right to refund.

Article 9 — Service availability

HebdoCook strives to ensure service availability 24/7. Interruptions may occur due to maintenance, updates or technical incidents. HebdoCook will inform users as far as possible, but cannot guarantee uninterrupted availability.

Article 10 — Personal data protection

The processing of users' personal data is governed by the Privacy Policy available on hebdocook.com. By using HebdoCook, the user accepts the conditions of this processing in accordance with the General Data Protection Regulation (GDPR).

Article 11 — Limitation of liability

HebdoCook provides the service "as is" and cannot be held responsible for service interruptions, data losses or indirect damages related to the use of the platform. The user is encouraged to keep a copy of their important recipes. The occasional unavailability of recipe import features (subject to a daily budget) does not constitute a breach of these ToU.

Article 12 — Force majeure

HebdoCook cannot be held responsible for the non-performance of all or part of its obligations in the event of a force majeure event within the meaning of Article 1218 of the French Civil Code (natural disaster, general Internet outage, government decision, major cyberattack, etc.).

Article 13 — Amendments to the ToU

HebdoCook reserves the right to modify these ToU at any time. Users will be notified by email of any material change with reasonable notice. Continued use of the service after notification constitutes acceptance of the new terms.

Article 14 — Applicable law

These ToU are governed by French law. In the event of a dispute, and failing amicable resolution, the French courts shall have sole jurisdiction.
